Step 1 — Employer Registration

  • Employers submit an online registration for selected candidates on the USCIS portal
  • Registration window typically opens in March
  • A small registration fee is paid per candidate
  • No full petition filing required at this stage

Step 2 — Random Lottery Draw

  • If applications exceed the cap, USCIS conducts a random selection
  • All registrations have an equal probability of selection
  • Results typically announced by end of March
  • No ranking based on salary, experience, or education

Step 3 — Two-Tier Lottery System

  • Master’s Cap (20,000): U.S. advanced degree holders enter first
  • Regular Cap (65,000): All applicants enter the regular pool
  • U.S. master’s degree holders get two chances — first in Master’s cap, then in regular cap if not selected
  • This gives advanced degree holders a statistical advantage

Step 4 — Petition Filing

  • Selected candidates proceed to full H-1B petition submission
  • Employer files Form I-129 with all supporting documents
  • LCA (Labor Condition Application) filed with Dept. of Labor
  • Unselected candidates must reapply the following year

Employer Creates USCIS Account & Registers

The employer registers on the official USCIS portal during the March registration window. Basic candidate details and a $10 registration fee are submitted. No full petition is required at this stage.

H-1B Lottery Selection

USCIS conducts the random lottery draw. Results are announced by end of March. If selected, the employer receives notification to proceed. If not selected, the registration is discarded and you must try again next year.

Labor Condition Application (LCA) Filing

The employer files the LCA with the U.S. Department of Labor, certifying that you will be paid the prevailing wage and that your employment won't adversely affect existing U.S. workers. LCA approval typically takes 7 business days.

File H-1B Petition — Form I-129

The employer files the complete H-1B petition (Form I-129) with USCIS, including the LCA, job description, educational credential evaluations, company financials, and all supporting documents. Standard filing window: April 1 onwards.

USCIS Review — RFE Possible

USCIS reviews the petition and may: Approve directly (best case), issue an RFE (Request for Evidence) requiring additional documentation, or deny the petition. RFEs are common — responding promptly and accurately is critical.

Receive I-797 Approval Notice

Upon USCIS approval, the I-797 Notice of Action is issued. This is the official approval document that confirms your H-1B petition has been granted. Standard processing: 3–6 months. Premium processing: 15 calendar days.

Visa Stamping in India

Complete the DS-160 online application, pay the MRV fee (~$190), and attend your visa interview and biometrics appointment at the nearest U.S. Consulate in India — New Delhi, Mumbai, Chennai, Hyderabad, or Kolkata.

Travel to USA & Begin Work
